Florida Inmate Sues Guards that Beat Her

WEIMAR, CHERYLAn inmate who requested medical assistance inside a female prison near Orlando, Florida was instead beaten by four male guards, according to a lawsuit filed this week.

The lawsuit that was filed in district court on Tuesday alleges the Florida Department of Corrections and four male guards of leaving Cheryl Weimar paralyzed as a result of a broken neck that she suffered in an Aug. 21 attack inside the Lowell Correctional Institution in Ocala, Florida.

Weimar has been in prison since 2016 and the guards were aware of her physical and mental disabilities.

The 51 year old female prisoner was arrested after she attacked her boyfriend with a knife. She was sentenced to six years and was scheduled to be let out of prison in 2021.

Weimar was asked to clean a bathroom at the Lowell facility as part of her work assignment at the prison, but she refused, citing a hip condition that caused her too much pain.

The guards denied her request and an altercation ensued.

The guards then allegedly dragged Weimar to an area outside the compound so they could continue beating her in an area that was not covered by security cameras.

Weimar is now a quadriplegic who has to be eat through feeding tubes. She also alleges that her civil rights were violated under the Eighth Amendment of the U.S. Constitution, which protects Americans from cruel and unusual punishments – the Americans with Disabilities Act and the Rehabilitation Act.

The Florida Department of Corrections told Fox News it couldn’t comment on the lawsuit, but the guards alleged to have been
involved in the incident have been reassigned to positions where they have no contact with inmates, pending the outcome of the investigation.

The Florida Department of Law Enforcement, which is the lead agency investigating the claims, will not comment as the investigation is still ongoing. Her attorney has not been able to visit her in the hospital as she is considered a security risk.
